In some cases, it may be an easement, which the homeowner owns. But in most cases, the area immediately adjacent to the road is right-of-way, which the homeowner does not own.
I'm not saying it's right to let your dog do his business there, because the homeowner does maintain it and it is for all intents and purposes part of the home's front yard. It should be treated as such IMHO.
