I have NO idea what is enforceable under Florida law, nor what the covenant not to compete may say in the employment contract. However, I have never seen a covenant that prohibited a patient from exercising a choice of what doctor to see. The usual provision is that the doctor may not operate a practice within X miles of the previous practice for Y months. The doctor also is not entitled to any of the patient lists, names, phone numbers or address. However I see no way that a contract could tell me the patient that I cannot see the doctor should I find him at any time. Lawyers? what is the rule in Florida?
