Hi potsie: While I agree the other side of the argument deals with the law. A lawyer could would and have focused on the construction requirements for seating, in this case a booth to see if it met construction standards. They would also point out any deficiency in notice of what they now term "the hazard". So by the time they finished with this restaurant a jury would believe that the restaurant owner with total disregard for his/her patrons knowingly allowed this hazard to exist. As to the being aware of your surroundings that is also easily overcome.
