It is possible to have surface mold and not have mold in wall cavity behind. While I am not a realtor, I would think that black mold would be an item that would have to be listed as a defect, and if remediated, the disclosure form should have that information also. I had a neighbor back up North that had LOTs of medical problems that appear to have been caused by mold.
The current owner and whomever is renovating the house may be in for a nasty lawsuit if this is not disclosed. This does not sound like a good situation.
