Then there would be the issue of intent. I do not think it would be very easy to demonstrate an intent to hit the other guy.
All the driver has to do is claim he was in fear for being harmed by an assailant.

I personally think the guy who got out of his car was the problem.
As my Daddy used to say "Don't get bubbles in your pee, chill out". Or something like that.
