Absolutely the dog owner should do the right thing and restrain his dog. But it doesn't look as if he respects his neighbors.
You've said you called Animal Control once and they visited the owner.
As has been suggested, call Animal Control again to see what your options are.
Or as Kitty suggested, take pictures and call the Sheriff.
