NO, you stand corrected. To be guilty of a crime, you do NOT need to be judged by a court. She is guilty but not convicted....YET.
Facts:
She conducted government business on a private server - guilty
She has transmitted sensitive to highly classified information on the unsecured Internet = guilty
She hired an uncleared person to maintain her computer, containing official emails (and classified info) = guilty
She instructed her staff to remove classified markings before transmitting emails to her - guilty
She sent emails of Ambassador Stevens movements (classified) on the unsecured/encrypted private server - guilty
This is documentation that is available on the Internet for everyone to peruse. She is guilty, just waiting for someone that has the guts to indict her and make it official.
The Clintons are also being investigated for tax fraud by the IRS, but I doubt anyone from the Obama IRS or Attorney Gen's office is going to buck the system.
So, yes she is GUILTY. She just hasn't been convicted yet.
