To make it real easy for you, so that you can't easily wiggle around this example, the Clintons STOLE thousands of dollars of gov property from the White House. Grand larceny is a felony. By paying restitution to the gov, they admitted their culpability. They are felons, regardless of conviction in court.
Hilary was found to have classified information on her unauthorized, unsecure computer. That is a felony. She confessed to giving her lawyer a thumbdrive with her emails that also contained classified information. That is a felony because he was not cleared for that information. She also employed several staff that were not cleared to work on her server which contained classified information. That is a felony. They have been given amnesty from prosecution. Why do I know these are felonies? Because that was my job in the state Dept, to know. There is absolutely NO requirement for intent, even though implied intent is evident when one illegally uses uncleared, unsecured personal equipment to transmit classified over the Internet.
