Law has changed on this. Employers now report tips -- Darden restaurants report 18% if no tip on charge card. Otherwise, they report amount tipped. Several other chains do the same. Smaller restaurants frequently report actual, known tips (why I leave tip in cash -- gives the server a little extra).
