The Obama folks went for court permission not once but twice. The first time it was not granted-very unusual. Perhaps, like Trump's immigration restriction, the second time the request was rewritten and it was granted.
Does anyone either a democrat or a republican believe they had the right to clandestinely listen in AND THEY DID NOT USE IT???????? The right to listen in would be limited BUT, since the conversations are not controlled, you would of course hear things not authorized.

There are 2 ways to get a wiretap. Either FISA or criminal.
In both cases, you must go before a judge and offer sufficient evidence to allow it.
NO President or any other individual can get a wiretap.
From reports, two efforts to get a wiretap. First was denied, second one was okayed.

Here is the problem.
A sitting President accusing his predecessor of a felony.
Where did Trump get the basis to say..just found out ?
One of his conspiracy theory websites has hinted at this the night before, and Trump pretty much just repeated it as an accusation.
When you speak of libel, it is the consensus that should the info bear out that Trump simply made this up, Obama may have a strong libel case against him.
This is typical Trump behavior, and there is a story out that says he went out and played golf, and when he returned he admitted he may have gone to far. The response finally from the WH was about all they could do because this is fraught with many legal problems.
A sitting President accusing the past president of such a felony is so incredibly immature and morally corrupt, it defies imagination.
As President, if he actually knew such a thing...he should have had a press conference and laid out the details for all America. As it was, he easily could have made one call and verified it in 2 minutes.
I predict this is FAR from over.
If he was wiretapped there was just cause to do it, and that is a problem.
If he was not, it is bizarre behavior for not just a President, but any human being to make such a charge.
