Remember that it was Chief Justice Roberts - a GW Bush appointee - that declared the tax (mandate) was Constitutional.

Yes, the Republican health plan did fail. Ryan and Trumpf (German slang for FART) could not gather enough Republican votes to carry it to victory. Therefore, it FAILED.
