Since the OP hasn't returned since he first posted there may be other things going on here.
I hate to say this but a used vehicle sale of any kind is "AS-IS" (even Judge Judy and Judge Milian will tell you that!). Unless there is a specific warranty written on a piece of paper or provable fraud (which isn't as easy to prove as it may seem) there is no warranty or refunds. A "verbal warranty" is very difficult to prove. I think there is more to this story than meets the eye. Even if the seller was a low-life scumbag without anything in writing the buyer is probably SOL.
As others have said, NEVER pay by check but unfortunately the seller probably didn't take CC's and required a deposit. If a price seems to good to be true it usually is.
