In Florida, generally speaking only birds covered by the Bird Migratory Act along some other special categories are protected.. For example house sparrows, which are extra noisy this time of year are not a protected bird.

VillagerBB, I wouldn't be surprised if noise was from sparrows. They have invaded (nesting) our palm the past two years and have driven off the bluebirds from our nearby boxes. We have gone from 2-3 broods of bluebirds a year, to zero nesting the past two years. And the sparrows are really noisy at times.

The other day while out working in the yard, they were even extra noisy. I looked over and spotted a squirrel, the first one we seen, climbing the trunk of our palm. The next day I noticed a dead sparrow chick under the palm. Don't know if was connected to the squirrel sighting but squirrels love to get baby birds.

Maybe you could do something to attract squirrels to your tree(s).

For us, no big deal in the whole scheme of things.
