Bargee, I'm guessing your legal counsel would advise you to sue everyone, the owner, the developer, the town, the state, the county.
Having had a little experience up north with a "slip and fall" on my property there, the person who fell sued me and the city. I was amazed at the process. Ultimately, it was a frivolous claim, but the city actually settled with them for a few thousand dollars. My insurance company fought. Went to a civil trial by jury, and they found for me, so the person who fell got (deservedly) nothing from me.

I think your counsel would advise casting as wide a net as possible to maximize your chances of getting any compensation.
