Well if a person is too stupid to figure out how to keep themselves safe, and their lack of safety could cause harm to people who are NOT too stupid to figure it out, then that stupid person will need to have the safety rules mandated.
Just like traffic lights - it's not to protect the smart people who know that they should stop at an intersection. It's to protect the smart people from the stupid ones who choose NOT to stop at the intersection.
