"On the other hand, when a mob forces its way into the U.S. Capitol past security, through locked doors, through windows, with the intent of subverting the Constitution of the United States and overthrowing our government and harming elected legislators, that is an insurrection and should be punished with the maximum penalty the Constitution allows for insurrection, which is capital punishment."
I believe you're confusing insurrection with treason, which is the only crime specifically called out in the Constitution. Per 18 U.S. Code sub-section 2383:
Whoever incites, sets on foot, assists, or engages in any rebellion or insurrection against the authority of the United States or the laws thereof, or gives aid or comfort thereto, shall be fined under this title or imprisoned not more than ten years, or both; and shall be incapable of holding any office under the United States.
