I question the claim that the property along the road is an easement and does not belong to the homeowner. If the easement isn't my property, then I don't have to mow the grass. Yeah, right!! See how long it takes the ladies in the red golf cart to lodge a complaint.
Here is a definition of "easement" I found:
Easement
An easement is a nonpossessory right to use and/or enter onto the real property of another without possessing it. It is "best typified in the right of way which one landowner, A, may enjoy over the land of another, B". It is similar to real covenants and equitable servitudes; in the United States, the Restatement (Third) of Property takes steps to merge these concepts as servitudes.
Says nothing about the easement not being the property of the landowner. You are still trespassing when you step onto the easement.
