In a case from 1988 entitled California v. Greenwood, the Supreme Court of the United States held that an individual does not have a reasonable expectation of privacy in their trash. Therefore, the Fourth Amendment does not prohibit law enforcement from a warrantless search and seizure of their garbage.

The slippery slope is that if one has to trespass on private property to reach the trash, then committing that crime invalidates anything collected after.
