a new criteria for gun control regulation that any rule that did not exist at the time of the adoption of the Constitution is unconstitutional. There have already been court decisions saying that anyone can
remove the serial numbers from guns as it was not prohibited nor did numbers exist in 1791 and a NY law that prohibited people from bringing guns into airports has been stopped.

Federal court in Texas has ruled that the Federal government cannot prohibit a person under indictment for a violent felony from buying new guns. This judge admits in his opinion that having to allow a person indicted for felonies the right buy and to keep and bear arms will have societal consequences he adds that he must find that the rule is based on a “general societal problem that has persisted since the 18th century,”
He adds that for the government to continue to enforce its prohibition it must have evidence from 1791;

If there was no historical regulation of gun purchase in 1791 any challenge to such rules will now perforce succeed. Under Justice Thomas's majority opinion which was a 6-3 decision, no gun control regulation which did not exist or very clearly derive from the situation in 1791 is now unconstitutional.
