That depends totally on the person you trespass against and their mood at any given moment.
Hypothetically, if fences were allowed and you were walking your dog in the street, as you do, and they squatted right there in the gutter, what would you do? Would you let them complete their function in the gutter or carry them over the fence and into the yard? I ask because where there is a property line there is an implied imaginary fence for every lot. In my case my lot is on a corner with a sidewalk on one side. It is a major traffic thuroughfare with lots, and I mean lots of dog walkers. Most make more than one trip per day. Most allow, and many actually direct, their dogs into my yard to sniff until they find the scent that triggers the urge to purge. The few dogs that are not alowed to sniff the grass never seem to need to go. Funny how that works. You are only walking one dog, so to you its no big deal. But I get,quite literally, dozens of poo and pee dumps daily. I can be watching Barney Fife, trying to enjoy my chili dog when some SOB drags his dog into my yard and let's him/her deposit a familiar looking heaping helping right in plain view. At that moment my normal warm feelings toward my fellow man seem to cool somewhat.
So you see, it's not about you and your small indiscretion, it's about the innumerable times it happens each and every day throughout the community and through the country.
