Yea, now it is up to each state. We HAD BEEN a "small retailer" for over 30 years and it was not allowed at that time. Our rate varied monthly based on volume and type of card (Amex was a killer). Connecticut and Massachusetts still don't allow it but now it seems the rest all do. It seems, after Googling, the change took place in/after 2013 which was just after we stopped being a "small retailer" and stopped being concerned about it.
