This is information in Florida law. "Punishment for Battery on an Elderly Person
This is a first-degree felony that is punishable up to 30 years in prison and a $10,000 fine. There is a mandatory 3 year prison term. The judge will order that restitution will be paid and the defendant must do 500 hours of community service." So who knows, maybe he will pay dearly for his stupidity.

I hope there are former lawyers on here that can corroborate, but I believe a
civil suit can only result in a cash settlement, not jail time which would require conviction in a
criminal case. Refer to the OJ Simpson trials for a similar situation.
As far as what will or will not result in prison, it seems that these days there is underenforcement of existing laws and underpenalization of convicted offenders. YMMV
