Right. Don't think pedestrians are bowling pins for vehicular pleasure. Even with crosswalk laws for pedestrians just hit one and see what Morgan and Morgan has to say about it.
Pretty sure only when you can proove you had no other option than hitting them, ie: it's dark out and pedestrian is dressed head to toe in black and steps out in front of you (even then, where your head lights working??) might you be found not at fault.
Breaks are made for stopping. Stearing wheels for turning. Pretty basic. Pedestrians have a duty to mitigate their damages as well.
Lots of people like to "play chicken" so if both parties are game then makes for a good "what's in your wallet?" moment. M&M loves that lol.
