But, the companies continued to pay claims they knew were not valid. Because of this, they were/are complicit in the scam.

You must remember, though, that the insurance industry pays out in excess of $100 million to lobbyists at the state and federal levels. These lobbyists work very hard to ensure that you, John Q. Citizen, pay the ultimate cost of any "crisis" endured by the insurance industry.
