IF insurance adjuster says that the roof is fine and the homeowner does not agree, in most cases, case goes into litigation and a jury determines if there is damage unless the homeowner and the insurance company settle the case prior to trial. Insurance companies settle cases as they can loose thousands more than the claim if they do not prevail in a lawsuit. If insured looses the suit insured pays nothing since they usually hire an attorney who gets paid on a contingency basis
