Because smoking is legal in open spaces, whether by 2% of the people or by only one.

Loud music can cause hearing loss, certain food aerosols can trigger anaphylactic shock, fumes from gasoline engines can cause severe irritation to those with breathing issues - being out in public involves some risk, such is the cost of living in a free society.

Why do people insist on making claims without looking them up first, do they really think no one will check? Proof by emphatic assertion rarely works.
