Here is the Florida Statues.. I suspect if you can small it they are in violation.

Call the local Sherriff Department.
That's a very long statute. Which paragraph speaks to not smoking if your neighbor can smell it?

EDIT to note: Nothing of the sort appears in the PENALTIES section of the statute.
