A simple call to Dept of Labor… Have you made such a call? I wonder how simple it truly is and how protected the employee will be if the Dept calls the employer to make inquiries.

If I were a server I would either say $2.13 if that was my base rate or I would tell you to mind your own business. Why should servers have to take being interrogated and judged about their pay?

Federal law requires a lot of things that don’t happen. That’s why we have fines, jails, and lawsuits. Unfortunately, challenging a dishonest employer is beyond the reach of most servers. (Which is why we have unions but that is a topic for a different thread)

Why do people insist on making claims without looking them up first, do they really think no one will check? Proof by emphatic assertion rarely works.
