Exactly. Done by filing a Proof of Claim form with the bankruptcy court. Practically speaking, there may not be any monies left in the bankrupt entity if one is not participating in the process. And I am talking about a plaintiff in an open or potential lawsuit. Those are indeed claims in bankruptcy. 11 U.S. Code ยง 101.
