When I was a deputy in Mahoning County, Ohio, two cars were drag racing on a newly completed, as of yet, unopened stretch of interstate highway. There was an accident and both cars rolled over. I issued a bunch of citations to both drivers. The judge threw every one of them out because it was not yet a public road.

I would have to question this judge. Almost every day in my area the state police issue citations in the Walmart parking lot, the local shopping center parking lot, etc. They are not public roads, they are privately owned parking lots. According to this judge a cop couldn't issue a citation for parking in a handicap spot with out a placard in a privately owned lot. Nonsense.
