Rubicon, at one time the proverbial "they" came up with the same idea as you did. They "sold" reserved tables on New Years Eve (yes - we used to have music until the year changed on that day). The local constabulary saw where it was going and anticipated lots of fights and riots over seating so put the quabash on it. "They" had to refund money to all who paid for a table and cancel entertainment for New Years Eve. From then until now, New Years Eve entertainment on the square ends of 9 PM, just like all other nights.
