Legally, they have to allow a small percentage of under 55. However, you don't have to be a resident to live nearby and drive on the roads, shop at the stores, eat at the restaurants, etc. Also, he did know the passenger they were friends he was lying to try to get out of trouble somehow. He was paranoid and in shock, and obviously drunk.
