The real problem here is that BHO circunvented the Congress to do this. He ignored the Constitution, He had solid Democract majorities in Congress for his first two years and could have gotten this passed the legal way.

Plus the Republican plan would have worked Constitionaly through Congress and then BHO would have to sign it.
