My wife & I have never had any desire to go on a cruise, and so this doesn't do anything for us one way or the other.
As far as the law suit thing...I just can't think that way. I wasn't brought up to think that way. Somehow as a people we've come to think that we have a right to be protected from all of life's disappointments and if things go wrong then we've been led to believe that somebody has to pay. I think that's nonsense. Sure..if the captain was drunk on duty or if Carnival & The Captain KNOWINGLY put out to sea in a boat what was KNOWN not to be seaworthy, then we're talking something entirely different. Then you're talking about criminal negligence. That's different.
Would I be very disappointed if my vacation was ruined? Absolutely! Has Carnival acted decently by refunding their money, giving them a free pass for another cruise and paying for lodging and other expenses? Yes. If we were on that cruise would we sue them? No. Sewage happens.
