I do think there is a penalty if the tree is bigger than 4". It's unfortunate that from what I can tell yours is bigger than that.

I have to say that oak trees in the right place are beautiful and should be encouraged and maintained but an oak tree in the wrong location is nothing but a big troublesome weed.

I was lucky enough to remove my Villages planted oak before it got too big.
