If one has paid for a seat to enjoy an experience in a public exhibition space and another patron is causing concern or distress and most likely breaking a "house rule " or perhaps a Public Ordinance the response is simple : Locate a responsible party from Management and point out the issue and / or change seats .
How could such a decision process be that difficult ?
I sensed from the o.p.'s earlier posts that he feared or wasn't sure whether to fear for retaliation from the guy because the o.p. was the only person near him, up at the top in the seating.

After the Aurora movie theater massacre, at an action movie like the one the o.p. went to see, it is reasonable to be suspicious of a person acting weirdly and nervously while digging in a large purse or tote bag....and chain smoking while nervous and where smoking is prohibited.

The bag
could have contained weapons and ammo as the Aurora killer brought into the action movie setting.

Now I'll wait for all the ridiculing "far fetched" claims. But nobody I know ever would have expected massacres like the Aurora theater, nor in classrooms of first graders in an all-american town like Newtown, CT.

Take a look at what the Aurora shooter had at this link. As an earlier poster said, "See something....SAY something".
