At this point, it isn't a criminal case. It is only an administrative complaint. If he refuses to accept the disciplinarian action from the medical board, the board would have to take legal action against him. But the part of the story that is missing, to me, is why the won't have a witness if they do this.

Given how difficult it would be for DOH to mount a case against Dean without the main witness, the state may lose, which would leave the board with no control over the doctor. Even if the state prevails it takes a long time to prosecute.
