I certainly wouldn't blame the restaurant. Unless you were specifically told it was a scam by the restaurant, it as as much of a victim as you and your credit card company. Sadly, some people are more honest than others. I'm hoping the police have caught the server who was doing this. In this day and age, it seems the prudent course may be to pay cash at any establishment where the card is taken out of your sight.
I am sorry this happened to you. It really stinks to not be able to trust and incidents like this are bound to make you much more cautious and less trusting.
