View Full Version : Do you need a Business License to rent out house?

Can anyone tell me if you need a business license to rent out your house as a vacation house in the Villages. The directions are quite confusing. Does every one in the Villages that rents out their house, need or have a business license?
Under the directions headed "What services require a state of Florida License? it states:
" A transient establishment rented for less than 30 days or one month, for transient occupancy with the intent that the guest's stay will be temporary, such as motel, B&B, vacation condo, vacation houses, etc."
Then it goes on to states... A Non-Transient establishment is a public lodging estabishment rented for a least 30 days or one month for non-transient occupancy with the intent that the residence will be the guest's sole residence. Eamples of non-transient establishments are apartmnets or roominghouses with more then four units.
Then it states that the list is not all inclusive, but just examples.
My guestion is: If renting out your house for 2 or 3 months to the same person, is it considered a Transient or Non-Transient Establishment and do you need a business license to rent it out?
Futher down on the form, under the heading "Does not need a DBPR License" it states:
Single Family hoiuse or condo in a building rented for Non-Transient occupancy o under a rent t own contract.
Can anyone help me figure this out. Thanks.

It probably would be the best idea to call the county tax office and ask them. That way you could get the answer first hand instead of possible conflicting answers over a forum.

I am out of State and have called and get conflicting answers. Would like to know if people that rent out their houses in the Villages, get the buiness license and have to pay Tangible personal property tax...such as on their porches, shed and carport.

I was a landlord for over two years in the Villages. You need to sign up for a tax ID to pay and submit your monthly tax returns to the FL DOR, Very easy to do online with ACH withdraws from your designated bank account. I had an certificate number but it was not a business license per se.
You have to file the monthly returns continuously until you take the rental property out of service, even if there is a 0 tax liability.
My rentals ranged from 2 weeks to 3 months periods, mostly monthlies. My rentals were categorized as "transient rentals" in category "D" of the tax return.

Check with the state rather than the county. If the same person rents it for over 6 months the taxes are different. The state also collects the county taxes and returns it to the counties. Check with Florida Department of Revenue on line. Very easy to send in the monthly coupon book.

I don't believe that is true...I checked with them and they told me that they do not collect for Lake County. It's up to the County if they want the State to collect and then send it to the county. So, it is county by county.

If you use a property management they should collect the appropriate amount of tax for you, but it is usually your responsibility to see that the monthly return is filed and the tax paid. You do not collect bed taxes if you have a lease greater than six months.
Check the FL DOR. And apply online. Fairly easy to do.
