View Full Version : Sex On The Square - crazy verdict

The man involved in this case has been sentenced to 6 months in prison, and besides the fine imposed, he must also pay $50 for each day of his incarceration, or a total of $9,000 dollars.
I think the verdict is outrageous. I have never agreed with those that have said they should not receive any punishment. After all, being naked in the middle of the square and having sex is way over the top. But prisons are meant to separate from society those whom would harm us. They committed a crime, but if ever there was a non-violent crime, this was it. What is being accomplished by this sentence. Certainly, not one of us is any safer because they were never a danger to any of us to begin with. I also do not understand the requirement to make him pay for his incarceration. While I do not like, as a tax payer, bearing the cost of a prison system, it seems to me that it is one of our duties as a society. How can we take away someone's freedom and his ability to earn a living and harm his ability to earn a living in the future, and then charge him for it. It just doesn't sit right with me. I really am flabbergasted at the verdict.

It may have been easier than living with his wife.
I am just kidding. Your sincere post makes sense, just as every single post you have ever posted on here. It was a victimless crime as you say and I have to wonder if those jerks who broke in and stole things got as harsh a sentence. I hope harsher, but it doesn't make sense.

I agree with BarryRX on this one. There must be more to the story or a rap sheet of past encounters with the law. Perhaps an appeal is warranted.
Anybody know much about the judge's background or his sentencing history?
Is he a "hanging" judge?
Back in 1995 he liked this concept. http://articles.orlandosentinel.com/1995-06-13/news/9506130101_1_jail-skidmore-sumter-county

Whoa! That is way, way out of line, IMO. I guess he pleaded guilty, then?
I have to assume that, if employed, he will likely lose his job after being away for so many months, in addition to whatever personal damage he's already caused to himself and his family.
What a damned shame all around. And remind me never to get arrested on a misdemeanor charge in Sumter County.

Yes - found it. I think it is absurd and Gracie he got more than the guys who robbed my friend! In fact they did not do jail time and she got NOTHING that was stolen back!
I would think it might be time for an attorney to get involved in a plea.

Several years ago, I heard that the prison system in the US was all about money. I poopooed it but as I hear more and more, I am beginning to see how this works. They need to keep those jails full and they are looking for $.
This is an excerpt from The Nation/prisons-profiteers
Privatizing Incarceration
No phenomenon is more emblematic of prison profiteering than the rise of private prisons. By now it is perhaps the most familiar and troubling trend for many progressives, and with good reason: the financial incentives involved are obvious and egregious. “It’s like the hotel industry,” says Alex Friedmann, an editor at Prison Legal News, who himself was once incarcerated at a private prison. “The hotel industry wants to keep their beds full as much as possible, because it means more revenue. Same thing for the private prison companies.” Two separate videos look at the two major private prison companies, Corrections Corporation of America (CCA), the country’s largest operator of private prisons, and GEO Group. Both companies made headlines in September upon the release of a report by In the Public Interest that scrutinized the “occupancy requirements” commonly found in private prison contracts. Last year, CCA sent letters to forty-eight governors, offering to take their prison systems off state hands in exchange for a guarantee that their states would keep their facilities up to ninety percent full—regardless of crime rates.
Is it any wonder we have more people in prison than any other country?
From a local level where they are overly ambitious giving expensive tickets for five miles over the limit to raise tax revenues or arresting college students for drinking which merits getting a "local attorney", our legal system is becoming very much involved in the business of crime.

However, SIX months for indecent exposure? His action did not harm anyone. It is a wrong sentence for the crime!

Unless a previous crime was a sex crime, it should be irrelevant if this man had any kind of record. This is so over the top as a sentence it brings shame to the word "justice." As one of my favorite authors used to say, "TANJIT" (there ain't no justice in this world). So sad, so ugly, so unfortunate.
Wonder what the ultimate sentencing will be for the woman given that she had broken probation for her DUI. Her poor husband.

It seems to be more about the place where this occurred-- Lake Sumter Square's pavilion and the time about 10:30 PM. There could have been teens around still. It sounds like there were not any kids around to witness this or else the sentence would have been even sterner.

I have seen much worse on here for sure !!!! MUCH
However, I am not one who likes to ridicule anyone, but must add that ALL of this....ALL of it...is HIS OWN FAULT, and cannot find a way to defend his actions.
If we can make fun and light of people for their VIEWS on things.....then I suppose breaking the law opens you up for even more.
I, for one, am confused about the discussion in the first place. Since it was a plea bargain, there is more involved than we know or will ever know and thus not sure what there is to discuss !!

Now you know why I don't want to live in The Villages. My interpretation of all this is that sex in the square is OK where here in Miami they arrest a homeless man for urinatiog in public. Additionally according to the recent poll more than half of the persons interviewed believe the Bible is mostly stories & fables. What next? I rest my case.

I do not think that anyone on TOTV sees sex of the square at 10:30 PM as OK. And, most of the Villagers never voted on the poll. On my own block there are many very regular church goers. These various churches are so crowded though that people go at different times just so that they can get a seat. Lots of Villages' churches have a number of services.
The Villages is very different from Miami or Orlando. I do think a homeless man peeing on the street probably would be arrested.

They probably thought they would just get a slap on the hand or it would be swept under the rug if they were caught and that is most likely why they chose the place they did in the first place.
They are not teenagers, they knew better, and had places to go rather than a public place. Being drunk is no excuse. It was time for the judge to send a good message.

The reality is that what happened on the square is big news because it occurred in a locale such as The Villages. It would no doubt be big news in a Sun City or a quiet, somewhat remote small town with not much going on. In Miami, DC, LA, SF or NY it would not be news. It would not even warrant a yawn.

I'm not a prude and I see nothing wrong with senior citizens having sex, even without a wedding ring (as long as neither is cheating on anyone). But the story says they had sex ON STAGE. That seems far away from common sense and decency, by any standard. There would need to be a truckload of alcohol before I would even consider that, and even then I don't think I would. STD rates are going up among Florida senior citizens, according to reports I've seen. I don't live in The Villages, but will be renting for three months (Jan-March 2015). Does that mean I'm not entitled to have an opinion on this? Or does the First Amendment only apply to The Villages residents?

I'm sure there's time to cancel your rental. And anyone's opinions are welcome, as long as they aren't full of sarcasm and vitriol, and statements not supported by facts. During my Deputy Sheriff days I sometimes encountered couples in flagrante delicto, including one couple in the right front seat of a Volkswagen Bug (you can only imagine) and they were simply told to get dressed and get on their way.
I suspect that there is more to this than we have been told. Since the female is pleading not guilty I wouldn't be surprised if her defense would be that she was so drunk that she didn't know what she was doing and was, in fact, the victim of non-consensual sex or rape.
The threat of a possible rape charge might induce the male to plea to the lesser offense. But, the judge, knowing the background, may have decided to give this apparently harsh sentence.
Only conjecture.................

Ditto. You'll soon discover that they like to "quibble" over viewpoints that do not paint an unnaturally rosy picture of their chosen lifestyle. They will attack your own "neck of the woods" for want of a reasonable retort to an opposing opinion.
If you do not care to "act like an immature cheerleader/jock type"; albeit an elderly one, then they are literally deaf to your comments or opinions.
I've been told via numerous p.m.'s that it's just a certain bunch of the same old gang that uses these unsavory tactics........that the majority are too afraid to post, or else do not even know that T.O.T.V. exists..........which I now tend to believe is the truth.
As far as having an intelligent "conversation", many seem hopelessly desperate in pursuing juvenile put downs just to be contrary........very childlike. But hey, our golden years might find us all in our second childhood........someday. I'm not ready just yet.........and find all of this nonsense immature, to say the least.
Everyone enjoys someone with a sense of humor, but using derogatory humor at someone elses expense is just plain childish. I've also come to the conclusion, from reading the posts that there must be some truth to the book Leisureville.......it's quite obvious what the past time of many seem to be............and it's not quilting bees or rebuilding an old schooner, hiking in the woods, nor volunteering at a hospital or veterans home. It seems more along the lines of hooking up, as the younger crowd calls it.
So very very desperate. It just pops off the page. Which they obviously do not realize.
If I was a man, there would be nothing more offputting than a mature female who feels she has to act like a teenybopper middle school little girl.......in order to attract a "date".......using baby talk.
Very sad that in our golden years, so many are still "on the prowl".......whereas in other areas of our country, one might choose to meet a new friend, who might develop into something more serious, if it was meant to be,........in a place other than a bar.............or out in public at Lake Sumter Landing. They must have really been plastered. Southern laws must be pretty strict about indecent exposure in public, although in a way it's really sad and embarrassing for that couple, especially given the huge age difference. He could conceivably be the age of her son. Very weird.
Guess we've lived in New England way too long.............private things go on behind closed doors.......not out in public on Main Street.......or in the center of town at the gazebo. Men are men; women are women and for the most part, act their mature ages, which is how most of us prefer it. More than likely, he will be on the sex offender register for the rest of his life and lots of narrow-minded people will see that and believe he is going to assault their children or grandkids.
When someone is a registered sex offender,
details are given regarding with whom,
what happened, where it took place, when, etc.
This man is not a sex offender per se, or a predator.
No one has to worry about their children or grandchildren.

That's what this harsh sentence was all about. They were out after curfew.
:a040::a040::a040:
Moving on.........
Tampa, NYC, Reno, Las Vegas are very different places than a retirement community where teens, grand kids and their grandparents might be strolling on the Square at 10:30 PM or so. I do believe you need to talk to cops who have been in retirement communities like this one or perhaps one of the Dell Webbs or Sun City.
Sex perhaps at the same time but on a golf course green would probably not face the risk of some teens or kids walking by and seeing this. Inside of a car would be harder to make a case for too.
And the defense lawyer will probably argue whatever has the best chance of getting her off of the charges. The facts rarely matter to lawyers representing clients especially defense lawyers. They might raise this rape claim. That does not mean that it actually happened. I believe if the prosecutor got wind that a rape was involved you would have seen a much worse sentence from the judge with no plea bargain involved. At least, I hope that would be the case. Prosecutors are supposedly given much less rein than the defense lawyers with tricks they can play.

Please feel free to stay in Miami. We won't miss you !

It may not make sense to you but to me it's disgraceful. I think what is even more disgusting is that the majority of folks there think it's OK. Because most have reached senior status anything goes. Is that how it is there nowadays. I am still naive & backward enough to believe that sex is confined private quarters with a married spouse. That's what seperates human beings from animals. It's offensive, embarrassing & a sign of the END TIMES we live in now. I also more persons with an opposing opinion should speak out as their silence is deafening.
Why are you on a forum for The Villages ?

They didn't have sex on the square. It was over by the water at the bait shack. :1rotfl:

This has certainly turned into an ugly thread. We TVers are accused of thinking the behavior of the arresting couple is acceptable behavior even when it is repeatedly stated that it is not acceptable.
Senior Citizen's comments are beyond the pale and not even worth a response, especially considering how often we have responded politely while she has made derogatory comments about TV and its residents.
Thank goodness for the ignore feature here. I, for one, know of two people that will be put on ignore from now on (not something I have ever even considered doing previously).
And, Carl, thank you for a reasonable/possible explanation of why the man would accept this sentence.

Most of us try to find things good not only in our town but in each other. And being silly and having fun and laughing until our sides ache is part of it. It is better than being young in many ways.

This entire situation is beyond sad.
It has been given too much press, both locally and nationally.
I don't believe for one minute, that we have been given all the facts
or even many of the correct ones.
The sentence this man has received is beyond belief!
Community service would have been a just and far better alternative.
It will be interesting to see what Mrs. Klemm's attorney can do for her.
Will it be the same judge?
I have a feeling there will be nothing fair about the final outcome.
As many posts have indicated, there have been far worse "crimes" with lesser penalties.
And to those who have worried about teens who may have been there, don't worry.
They've seen more than we have and probably have better stories to tell!

An informed opinion.
You say the story says they had sex ON STAGE. You have no idea of what this stage looks like so the emphasis isn't necessary.
The STD rates you read in some reports have been debated to the nth degree here on TOTV. Do a search to better understand those "reports" you read.
Come back here and post your opinion after your 3 months.
BTW you will love The Villages and you will find there are thousands of residents who don't give a damn what is posted on here.
