TCL Lawn Service Denies Breaking Window

I have been using Tri County Landscaping for the past 6-9 months to mow my yard. Yesterday they came out around 5pm to do my yard, just as I was leaving in my golf cart to go to an activity. My car was parked in the driveway. When I got home last night, I noticed that my front passenger window was totally shattered and that there was a small hole about the size of a small rock in the lower corner of the window.

I drew the conclusion that the lawn service guys had accidentally run over a rock in my flower bed or around a tree that flew up and went through the window. Last night I called Tri County and left a message of what I thought had happened. And this morning, I saw the crew in my neighborhood and asked them about it. They said that they had not done anything and were surprised at the broken window.

As of the end of today, I still have not received a call from Tri County acknowledging my call. It is possible that the workers did not notice what they had done to my car...with the loud motors on their machines...but I am very disappointed that the Tri County office did not try to contact me.

I am in the process of finding a new lawn service...not so much for the accident...but for the way that their office treated me (or did not treat me).

I have been using Deans for almost a year. A couple months ago, they hit a pipe in my yard. The mower operator promptly let me know what happened and called the office. They were out the next day to repair. I have been happy with their service.

We used them a few yrs ago and the damaged my garage siding trim. When I finally got the mngmt person out he denied their guy damaged it, but said they would repair it. Never heard from them again so we fired them.

So if the OP is correct and TCL mower had thrown the rock are they liable?
Where did the rock come from and how did it end up in the grass?

Can OP make a case that TCL did the damage?

Suppose there was a stone in the road and a vehicle driving by threw it up into the window?

The damage to the car window is covered under comprehensive and a doubt a deductible applies

It is reasonable to understand why the OP would believe TCL is responsible as it is a logical assumption however, since he cannot prove it he may want to rethink casting dispersions on TCL

They send people to death row on circumstantial evidence, and I suspect the mowers did it and the guy riding the mower never knew it. I don't think it's about the money, insurance does cover it, but it is about the company not reaching our. I would have done the same thing, the good news about competition......if a company doesn't meet your expectations you have no obligation to remain their customer

jomar: But are they liable? Just because they threw the rock, if they did, doesn't mean they are liable. How did the rock/stone get in the yard? What act of commission or omission did they commit. Do you think TCL has an obligation to walk each yard before they mow it to look for debris?
Should the policing of the yard belong to the homeowner? is it reasonable that a homeowner will police his lawn before a TCL shows up.

I do agree with you TCL could have thrown that rock/stone and they may have well known it but what you and I think and what you can prove in a court of law is night and day

rubicon: I agree with you and a court wouldn't come into play...insurance would cover it...my issue is when you call a vendor they should call you back in a reasonable time. Even if, at the end of the call, you agree to disagree the vendor needs to show respect to the people who are their revenue stream....and not returning the call is unacceptable.
