View Full Version : Service Smart Refusing Refunds to ex Stellar Contracts

Service Smart is flat out refusing to refund your money for the remaning months of your contract with Stellar if you try to cancel. The right to be able to do this was the main reason we went with Stellar and their show stopper package in the first place. SS also will not honor some of the services that were a part of the Stellar package, ie Aeration (they no longer have the equipment to do this). A friend and former Stellar manager has told this was not a merger, but a total buy out of Stellar and this is why they will not honor the terms of the agreements between customers and Stellar.

Unfortunately I'm stuck with SS until the end of March, but am planning to switch as soon as possible. Maybe if enough disgruntled customers drop their services they'll get a hint.

The good news is that a few new landscape operations are starting up, run by the former cream of the Stellar staff. If you are interested, speak to Chris Greene, Ben Miller or Brian Johnson at Green Inspirations Inc, 352 497-7857

Just another good reason not to sign a long term contract with a landscaping company no matter the discount. Better yet, perform the services yourself, if you can. Lawn mowing is good exercise...

Stellar customers are lucky the company did not declare bankruptcy. Then if you paid up front you would most likely get nothing.

I'm sorry to hear SS's attitude but not particularly surprised. SS is just following their old practices and reputation.

If Service Smart bought Stellar as a corporation, Service Smart has no choice but to honor ALL of Stellar's legal obligations. However, if they did an asset purchase, they are under no legal obligation, but by ignoring their moral and ethical obligations, they stand to lose in the long run.

I have plans in the making on taking them to Small Claims Court..
Just hearing the Court tell me this will satisfy me.. I have only my
time and a few dollars left in the Contract... Satisfaction is everything at
70 yrs old.

My contract with SS was up two months ago. I did not renew

Does anyone know if Stellers contracts were "novated" over to service smart?

If so I believe they become service smart contracts and enforceable. I'm not a lawyer but I stayed at a Holiday Inn Express once.

If a small claims court upholds their contracts as written, I expect many to pursue them in small claims court. We have not been happy with the transistion either. Sent a concerned but cordial email via their own website detailing my issues. And I received NO response. It's been two weeks.

So many other companies out there. Sad case.

WOW, not sure if I would go that far BUT, I had a contract with Sellar, never told about the switch and Seervice Smart did come and do lawn. We told the service man that we were never told and we did not have a contract. He stated that he had heard that alot and that he would tell the bosses. We still have NOT heard anything. I must say they did a good job on the lawn!

I would definitely contact Seniors vs. Crime. There were two people here that mentioned small claims court. Can you do a class action with small claims? There's always Morgan and Morgan, for the people! LOL

At least when Sellar a unfriendly post on here they would answer with a post on here. Guess Service Smart does not care!
