View Full Version : Driveway damage from neighbor's tree

Where do I file an official complaint about a neighbor's tree whose debris has caused our driveway to become stained when it lays on our concrete for too long? We recently had our drive stained professionally to keep it nice, and now it's looking worse.

Ok, assuming your not a troll why would you decorate your driveway knowing that your neighbors tree debris causes staining ? Seems like good money down the drain to me. Anyway, again assuming your not a troll the problem is yours not your neighbor. His tree debris now belongs to you. Think of it as a gift that keeps on giving. Or, I'm not saying you should do this but a cup of gasoline poured evenly across the trees drip line once a week for a month or two should take care of your problem for good.

If a neighbors tree falls in your yard, it is your responsibility, not your neighbors, to remove it so I assume the same is true for any debris.

Any branches that overhang your property line you can legally cut off/down.

It is true if the debris falls naturally. If the neighbor trims his tree and the resulting debris lands on an adjoining property it still belongs to the tree trimmer and being a diligent trimmer, he should remove it, IMHO

Unless you damage the tree enough to kill it so be careful. I doubt that would solve the problem since winds do blow debris all around and a badly trimmed tree is not very attractive even if it is your neighbors. Better to just buy a blower and clean it yourself.

Apparently not when they are clear cut for a better view.

I dont know why I'm surprised. My sister owns a ground floor condo. The pipes broke in the unit above hers and flooded her unit. It was my sisters responsibility according to law to fix her damage.

Most of your answers are humorous and made me laugh. But seriously, I understood to begin the process of having The Villages ok the removal of a nuisance tree, it begins with someone filing a complaint - I thought it was filed to some group within the neighborhood or district. I'm asking if anyone knows this process. I live in Belvedere.

The rules can vary somewhat from county to county and VDD. Figure out which VDD you are in and the start searching here: http://www.districtgov.org/search/SearchPage.aspx?usterms=Nuisance++tree+removal

I don't know which VCDD Belvedere resides but HERE (http://www.districtgov.org/departments/Community-Standards/community-standards.aspx) is a link that will let you find/read the your District's regulations regarding tree removal. Also gives contact information.

Joyce,
That does not sound correct. I sued my above neighbor for the same thing, I won, that was in Ft Lauderdale, back in 1997. Bill

Basically, it is the problem of the owner of the driveway. If a neighbor's leaves fall in your yard or are blown into your yard (back up North), you would not expect your neighbor to rake them up, would you?
Same here, the debris on your driveway is your issue to get off your painted driveway ASAP before it stains.

What you describe is hardly a nuisance tree. Sounds like a normal, healthy tree. And you are responsible to clean what falls on your property.
You can trim branches that hang over your property, but not such that it damages the tree.

Before we moved here year 'round. We returned from our snowbird months to find that our next door neighbor in Cincinnati had really cut at our huge tree and he said it was because it was blocking his satellite dish.
We did nothing. We filed no complaint. It looked like hell. Sometimes living peacefully is worth swallowing hard.

The problem I see is that in some cases there are multiple trees on a street. When the wind blows, it can deposit leaves from any of these tree onto anyone's property. How exactly does one determine from which trees these leaves came?
There might be leaves from multiple trees on your property at any given time. Are you supposed to sort through them and return them all to each of your neighbors from whence they came?
Trees exist, they drop their leaves, (even when trimmed), their leaves blow in the wind. No one has control over where they end up.
Even if the person on whose property the trees wanted to take down the tree, it requires an act of congress in this area.

Just curious, did he come on your property to do the cutting or did he cut branches that overhung his property? If it was the former and you did/said nothing then you are truly a better person than me as that would not have gone over well with me. If it was the latter then I would have been OK.

I am sure that led to a great neighbor relationship. Your neighbor could have complained to the authorities that you were trespassing if you came into his yard - especially with a leaf blower.
Wouldn't it have been just as easy to use your leaf blower to clean up the leaves in your yard instead of antagonizing the guy next door?

Yes, it should take care of your tree problem - but you would be liable for the replacement cost of the tree - and I assume we are not talking a sapling. That could be thousands of dollars PLUS criminal charges.
Very poor solution as well as showing TOTV what kind of a neighbor you are.

Unless your neighbor directly caused the tree debris to land on your driveway it is just the law of gravity or nature blowing in the wind. Be happy it's not fall up north.

I've really enjoyed reading this thread, which has some accurate responses and some travels far afield.
In summary, if you are talking about a healthy tree shedding leaves and twigs in the normal process of nature it is most unlikely that you can have it declared a "nuisance."
So......in answer to your question of "Where do you file an official complaint...?" This answer is as good as any:
Go to a town square and whistle Dixie........for all the good it will do.
(For the benefit of our many transplanted citizens, the general idiomatic meaning of this phrase is: "to engage in unrealistic fantasies; waste one's time")

I have a neighbor that was raking my yard when I first moved in. I asked her why she was raking my yard and she told me that the neighbor on the other side turned her in because her tree leaves were falling in that lady's yard. She said that she was told by TV that she had to clean up the leaves from her neighbors yards. She has been doing this for years, never in my life have I herd something so nuts as that. If I am raking my yard and the wind blows what I am raking over in the neighbors yard I would go retrieve those leaves but what the tree drops in their yard is theirs to keep.

If a live tree , on your property, falls on your neighbors property it is their problem. If a dead tree , on your property, falls on your neighbors property it is your problem.
I had a live tree , that had actually started to go had in the center, break and fall on his garage. You could not see that it was going bad. Full leaf growth.
The first thing the insurance man asked was "Did it have leaves"?
I offered to pay the deductible. He said no. He got a new garage roof for $500.

I THINK that I shall never see
A poem lovely as a tree.
A tree whose hungry mouth is prest
Against the sweet earth's flowing breast;
A tree that looks at God all day,
And lifts her leafy arms to pray;
A tree that may in summer wear
A nest of robins in her hair;
Upon whose bosom snow has lain;
Who intimately lives with rain.
Poems are made by fools like me,
But only God can make a tree.:cryin2:

I'm always a little surprised by this statement. Of course TV is not made up of large lots. And there are many subdivisions with much larger lots. But lot sizes in TV are not unusual. In fact they are common almost everywhere...enough room for the footprint of the house. ~5' to 7' side setbacks. ~12' rear setbacks. ~20' front setbacks. Not unusual at all.

Here is my suggestion. Think how it would be if your tree or long ago your kid bothered your neighbor? You wouldn't defend your tree or your kid I hope. But things happen. Sometimes we need to put a little patience in our bank and pull it out when needed. Our neighbor needs to do the same.
Do unto others as you would have them do unto you.
I think I just prosell-itised.
But it is a beautiful day in The Villages. I think we will get a warm, soft, spring rain.
Good morning all.
