golf cart disclaimer

I will be renting a home with a golf cart, and have been asked to sign a disclaimer accepting all responsibilities for accidents,property damage and personal injury. While I believe my home owners policy may apply, does anyone have any thoughts on this? The disclaimer also states the tenant is responsible for any damage to the cart. I would think the owner of the cart would have it covered in their home owner policy. Just wondering.

Gurgles is the renter. And I would ask anyone renting from me and getting the golf cart to also sign a disclaimer. And if they rent the cart from any of the many places that rent them, they will be asked to sign the same disclaimer.

The "disclaimer" is just about worthless. It's not possible for the owner of the cart to have a permissive user sign away the rights of third parties to recover for the negligence of the owner or operator of the cart or car. Injured third parties will pursue operator and owner. Disclaimer offers nothing from that perspective. If the operator drove into a tree and damaged the cart they would be responsible for the damage, but third parties aren't limited by a "waiver" between owner and operator/renter.

Standard HO policy covers golf cart operation while involved in golfing activities and not much more. Leisure travel around TV won't be covered. So when using the owners golf cart the real issue is if the owners golf cart insured seperately and does the policy provide coverage for permissive users (the renter)? Some policies exclude coverage while the golf cart is "rented to others". So you have to deal with that also.

It's a lot more complicated than one would think but the real issue as a renter/user of the golf cart is whether or not the cart is insured and am I, the renter, covered. If not, can I get some type of short term policy to cover me while I'm using the thing.

Unlike renting a car, in which one of your own auto policies provide coverage for the typical use of a rental car, the only policy providing coverage for use would be the limited coverage offered bythe HO policy, or if you had your own golf cart insured seperately, it would most likely apply.

Wouldn't the same sort of rules apply when you rent any golf cart on any golf course?

When you rent one on a golf course, your HO policy applies as that's the intent of the policy, to provide limited protection for occasional use of a golf cart in golfing activities.

Thanks for taking the time to draft an explanation of the possible liabilities. One of my relatives is renting their patio villa through a local real estate agent. We're storing his golf cart because the agent told them not to include it in the rental. Now it makes sense.

Our golf cart is on our auto policy with essentially the same coverages. I think it runs about $ 100/yr. You may wish to check w/ your auto ins. agent for clarification.
