View Full Version : Got Hit in Wal-Mart Parking Lot

Went in to pick up a few thing and when got back to car the right rear fender area was hit. Not a tap but a pretty good hit. Deep scratches on rear fender. There was also a couple of small scratch at the top so maybe could have been a golf cart. The person that run into my car would have known it based on the damage. No note no nothing. Can't believe people today, just hit and run.

Maybe it was caught on Walmart cameras. They probably have them in the parking lots.

Happened to me at Billy's Cafe a couple of years ago, also no note. I had a brand new car and it got smashed. It was basically how sad too bad for me. Sorry this happened to you.

There are a lot of people driving without insurance, insurance with minimum coverage, or just don't give a darn about others. I parked a brand new van out by itself at walmart years ago and a woman in a beatup,old huge car parked right next to me and her kids banged open the doors on the van. She acted like nothing happened.

I asked about cameras and they took my name and number and said they would call if they saw anything. I doubt if they even looked!

When I have to go to Walmart, I park on the most least likely traveled side, past the liquor store, and around the corner from there. Very seldom are there any vehicles parked there, so I know my car is safe. Might take a few more steps to get into the store but worth it to know my car is safe. The few dollars I save at Walmart aren't enough to cover the damage to my car when people side-swipe you, back into you, bang their car doors into your car, or leave their carts in a parking space to roll into the side of your car.

I make it a point not to park next to someone that has not maintained their car and already has dents on it. I am banking on the fact if a car looks good they will be careful getting in and out. I also try to park next to SUV's that have sliding doors and not those that open outward.
Any way the 1st we I was at The Villages someone scratched my bumper backing into it fram a parallel parking spot.

That's why I park in the lower 40 whenever we go anywhere. I drop my wife and her Mom off at the door and park waaaaaaay out away from everyone. And so someone doesn't ask, I walk back out and get the Escape and pick them back up. No dents = me not pi**ed off.

We parked in the "lower 40" when our new car was only a few days old! Same thing happened to us on left rear. All we could tell was it was a red car or truck! Cost $750! Can't believe people!

We were at the Savannah center one night and saw a woman hit a car trying to park, then move to another space and get out of her car and start to walk away. I yelled at her "lady, you just hit that car". She then went back and put a note on the windshield of the car she had hit. I didn't check the note. For all I know it was a blank piece of paper.

I know it isn't funny to you but I cracked up when I read it. People need to take down the tag numbers of others and this might motivate them to be honest.

Jima64 - No worries. That's actually a picture someone sent me as a joke, however, I did once find a note that basically said "Sorry, wish I could help you, but don't have insurance or job." Luckily, it was only some paint that needed re-done, so no big deal. But these types of incidents can be both costly and demoralizing, for sure!
Go into Walmart and ask the manager the name of their insurance company. Deal directly with the insurance company. Even if they have signs in the lot proclaiming that they have no liability, they actually do. I was once hit in a parking lot of a grocery store up north. Then manager told me that they have no liability because of the signs. He finally gave me the name of the insurance company and they did indeed pay the $450 repair bill. It is certainly worth a try. I had a police report.

Just out of curiosity, why in the world would you assume/believe that any merchant would or should have liability for parking lot dings to vehicles?? I can understand liability in parking lots for lots of other occurrences (assaults due to poor lighting, slips due to poor de-icing, etc.), but for some idiot banging into my car?? How exactly do you draw that conclusion?

Unfortunately a lot of people just don't care---I would guess no insurance. I believe that the parking spaces are a bit larger in TV too .

If you file a police report of a hit and run, are they obligated to do some sort of investigation? If so, then certainly the police would access the Walmart video as part of their investigation. Walmart may not carefully look at the tape, if at all, but hopefully a police agency would make an effort. I have no idea how long the records are kept before deletion so speed in making a report may be important.

Some people don't have the decency to return their cart to the shopping bin, let alone, go through the trouble of staying around and admitting their culpability, when they hit, another car.

Simple. It happened on their property. Liken it to a customer dropping a jar of sauce on the floor and another customer slipped and fell on it. The store didn't place the sauce there but they are still liable. Apparently their insurance company agreed with the logic.

I'm not sure what the law is in Florida on "bailment contracts", however a sign on a property by which the property owner declares himself free of liability does not necessarily make that so under certain conditions.

You're right, and I'm not advocating such an action...merely suggesting that a unilateral statement made by a property owner does not indemnify him against a legitimate injury. Obviously, a specious claim is never justified.
That said, if Walmart is negligent in removing stranded carts from the parking lot, for example, and a car leaving or parking pushes that cart into another patron's vehicle and damages it, I would think that would be a case where the vehicle owner would be justified in filing a claim on Walmart's insurance. That's what liability insurance is for. Just an opinion...

This is a universal problem. Can and does happen at all shopping center and parking lots, not just Wal Mart.
To the OP ask to speake with the head of security in person. Don't wait too long they re-write over the tapes. Take the Security officer out to the spot were you were hit then he can identify what camers could see the action. If you show inititive they will be more likely to help.

My understanding is even if an accident is no fault of your own, your premium will get an increase!
That's just the way it rolls in FL. Some insurance companies may charge less but the insurance companies only care about recouping monies spent.
It doesn't makes sense to me if you have a $600 accident, they increase your premium $200 for 5 years. Why are people paying their insurance premiums for, if they are going to charge additional monies, to recoup all of the monies spent and then some.
I may be wrong and I frequently am.

Hit & Run Corvette Vs Golf Cart Morse Blvd
4:40 PM on Morse near San Marino close to the Mailbox Center, my wife was south bound in a gray Corvette black top convertible when a green golf cart made an abrupt left turn hitting the right front wheel and proceeded to slide down the passenger side of the car. Her first reaction was that the gentleman was injured. She pulled off the side of the road and the guy made a U turn and headed off in the other direction. He was wearing a straw hat with a black band. The golf cart was green. It has to have some serious front end damage. A witness tried to find him but without success. We have a witness statement but would like for anyone with information to contact me.
The green golf cart driver may have injuries. Although Corvettes are fiberglass, it still takes quite a bit of force to punch holes in the quarter panel, tear a mirror off, and shove the door back so it won't open.
The car has been repaired and looks great. Final bill was $7600. Still not a clue about the HIT & RUN DRIVER.

Ed Zachary. It's what is wrong with this country today. People holding a store responsible for something they could not prevent (the spill, slip and fall scenario is totally irrelevant in this discussion). Same folks probably gripe when ketchup goes up 10 cents while they're trying to get something for nothing.
