New to Florida and I was wondering about law. since there are many here who can find it, on sitting drunk or with drink in cars on your property.

On my driveway (not in the garage) can I sit in my Mercedes with a couple friends, at night, listening to music, chatting and drinking. No key because Benz.

I ask is because With a lot of people over, sometimes, you want o go into the car, chat, have AC, and listen to music.

I have seen that people get arrested drunk and car on.

We would be playing music, having a great time. Car would never be in gear and never move. Just need the engine to get the AC running full on.

I don't know the laws. The neighbors would not mind and never hear anything.

If this is/was a serious post by the OP, it hands down has to be the most absurd question ever asked. Basically, is it ok to sit in a vehicle which is running, and either be intoxicated, and/or consuming alcoholic beverages. Despite the absurdity of adults sitting in a car in the driveway listening to music and drinking, this still is clearly beyond comprehension.

I think an open container in a parked golf cart in the square is a violation. My guess is you would have a problem in your driveway with the motor running. I would also ask your neighbors if your music is too loud.

It might be worth trying in your neighbor's driveway before you do so in your driveway . But never in a Benz especially if it is an E-Class or higher and if you paid cash .

OK.

First - This is not the place to ask if something you are about to do is legal. You will get lots of answers, but how can you be sure any of them are accurate.

Second - If you are from up north and not used to our summer humidity, I can understand wanting to sit in air conditioning. Is it a little strange to sit in a car? Sure, but not worth an insult. Maybe try one of those cheap box fans.

Why not just buy an RV instead of a MB? You can park it for 3 days as long as you don't plug it in so get one with a generator and park it in your driveway
when you have guests. Be sure to include your neighbors to prevent any complaints.

I think what he asking is can he get DUI, DWI, PT setting in his car in his drive way on private property ? IMO I would not want to be in car with opened container or empty container no matter where I'm setting. the reason IMO once the LEO writes ticket or arrests you are guilty. You have to get lawyer (the shady the better) to prove you and innocent. All $$$$$ I care not to waste.

I also think this why we see all the discarded beer cans and whiskey bottles along the MMP. Open/empty container law in vehicle? Once you gulp down that Shyt you get rid of the evidence? :thumbup:

Don't waste gas. Here's what you do. After the sun goes down, take your boombox and cooler, go up on your roof. Works great when there's a slight breeze and you have privacy from the annoying people in your home as well.:D

Take a drive down the MMP from Hillsborough to the Brownwood area. You'll see empty beer cans and mini liquor bottles.

There have been recent arrests for people sleeping/passed out in cars that were not even running and some with open containers in cars/carts that were parked. Short reply - NO open containers or drinking in vehicles.

I don't see the problem being on private property BUT what do the visitors do after this little gathering?? Do they sleep in the car to sober up before leaving? This is a little strange. Sounds like you need to invest on upgrading your patio.

VILLAGETINKER, even if this person did do exactly what he said & had no keys to listen to the radio. Don't you think this very strange? I don't think this person could get arrested just for sitting in his car drinking with his friends, unless if a police officer did think he & his friends just got back from drinking somewhere. Open container laws can vary from state to state, and in Florida, from county to county. However, the rules are pretty specific - with the exception of a motor home, alcohol may not be consumed in a motor vehicle, no matter where it is parked. Having the motor running is even worse, as this amounts to having physical control of a motor vehicle while consuming alcohol, which could result in arrest, and points on the operators license if convicted. Here's the Florida statute on the subject: Statute 316.1936

If keys are in the ignition running or not (or even in the car) and occupants are intoxicated or have any open alcoholic beverages it is illegal no matter where you are. If neighbors lose their sense of humor and call on you, you will be arrested!

This may be jest, or semi-just, but I think its an interesting question.

I am not a lawyer, but reading the law seems to show that it is legal, unfortunately.

Open containers applies to roads and certain accesses to roads. The law reads:

"“Road” means a way open to travel by the public, including, but not limited to, a street, highway, or alley. The term includes associated sidewalks, the roadbed, the right-of-way, and all culverts, drains, sluices, ditches, water storage areas, embankments, slopes, retaining walls, bridges, tunnels, and viaducts necessary for the maintenance of travel and all ferries used in connection therewith."

Driveway is not a "road" or a way of travel by the public, its not a sidewalk, etc.

I think it should be illegal. Drinkers cannot guarantee that they will remain quiet and keep the peace while sitting in a car getting drunk. Even before they are drunk, a loud boom box from a car stereo is very noisy indeed. Also, I hope the drinking mates live within walking distance and are not driving home.

Why not get a he-shed or she-shed ? (I'm unsure of the poster's gender) Why not get a misting system for your backyard? But even as I say these things I am loathe to think of the noise you may create for your poor neighbors. If you come from a place where people made drunken party noises outside, you need to change. The Villages is not like that. I'd instantly call the police if I heard the slightest drunken party noise while I was inside my house. They would come, because there are laws about making noise. Normally, you are fined upon a second occurrence. Noisy parties are to be inside with the windows shut and the AC on, or else not at all.

The driveway is OUTSIDE & in public. Many municipalities prohibit public drinking even if on your property cause technically you need to have a license to serve or drink alcohol in public.
