We had breakfast at Denny's this morning, which was good. When I went to pay with my debit card the lady told me it had been rejected and i had to use another card, which I then gave her another card which was fine. When I got home I checked my account and found out that they had lied to me and my debit card had cleared and was charged. I returned to Denny's and ask for a debit to my account which they would NOT give me. Now I have paid for my meal 2 times and they won't credit my account back for the one they said did not clear. I called the bank and they told me I had to get a credit from Denny's, which Denny's refuses to do. These people are crooks and are lying to people in order to charge two times for the same bill. I will never go back to Denny's and recommend people watch them and how they charge you.

Document both charges. Call their Corporate Office and report the incident, especially the location and manager that refused to credit you back.

You didn't mention whether the second card you used was a debit or credit card. There is a huge difference between debit and credit cards with respect to your legal rights. When you use a credit card, you can dispute a charge and the bank must immediately credit your account and investigate the issue. This is required by Federal law. But, if both cards you used were debit cards, then you are stuck with whatever rules the bank has decided to use for debit card disputes. That is why using a debit card is almost never a good idea.

You usually need a Debit card to receive cash at the ATM or even at the Teller.

Agree. With credit cards if you have a disputed charge they process an immediate credit and if your number is stolen you have zero liability with most issurers.

There are exceptions. My hairdresser won't accept tips on a cc. Cash is required many times in foreign countries, esp. small villages, and a debit card that doesn't charge a foreign transaction fee is a must.
If you get cash at an ATM using your cc, interest starts being charged from the time you take the money out. Plus you have to scour your bill to find that interest charge, because it's not included in the usual transaction part.
I like to tip in cash at places like my dog's groomer, because if you add it to the cc, they have to pay taxes on it.
Oftentimes we will pay cash for meals out rather than having a wait person whisk away our cc.
OP should call the cc company and dispute that charge since the debit people won't help him. He has already contacted the restaurant and verified that they won't help him. That will count with the cc company.

cash is still need to pay many things, purchase from private individuals, such as in classified items m Facebook marketplace. Small tips for bellhops, cleaning clubs, some parking venues, I also give a tip to the airline attendants serving drinks, purchased my golf cart with cash (I was able to get the deal rather than someone else wanting them to meet at a bank). I

Stop the payment on the 2nd card. I've disputed charges and had them reversed on my Visa... Just have your documented proof they charged twice on 2 different cards.

The credit card companies wouldn't and couldn't exist if people weren't carrying balances month to month. So, even with "cash back" or "points", they're making out just fine. I always pay my full CC balances each month, but lots don't. And the card issuers are doing great.
Additionally, in some areas/states, gasoline is higher if paid with a credit card vs. a debit card. Some might find the difference negligible, but we seem to judge price differences on percentages and in context to what something would otherwise cost, vs. the actual $$ of what we pay with one method vs. another. If a fill-up is going to cost $2.00 more with a CC vs. a debit card, that leads to debit card purchases.
I will use my CC wherever I can for purchases because of the protection factor and the points, such as they are. But I'm not ditching the debit card. I do have digital notifications set up on my debit card where any purchase/transaction over $5 triggers a text or email to me. I can lower that $5, of course. But I would know instantly if my card was hit.
For the previous poster's "tipping" issue - I tip in cash, not with a CC or debit card. Of course, it takes cash to tip in cash, and that comes from a debit card, in my case. I'm thinking most people who work in a business where tips would be expected would - if ranking the choices - prefer cash tips vs. something on any kind of card where they would have to wait (and hope) for management to disburse the tips.

Use a credit card, it is safer overall and much easier to claw back an incorrect payment.

The bank can not help you while the charge is in a ‘pending’ status. It usually takes a day or 2 before the charge hard posts and actually debits your account. If the amount actually does post to your account, then go back to Denny’s and ask again for the reversal credit. If they refuse, then go to your bank and tell them you want to dispute the charge. The bank is obligated to refund you the money and will go after Denny’s to recoup the charge.

Yes, when asked by my bank if I wanted a debit card I said no. Don't have any, don't want any. Credit cards are much safer.

“One of our investigators actually did some surveillance yesterday afternoon and to his shock, here come these guys in broad daylight, opening up the gas pumps to put in these skimmers,” said Seminole Co. Sheriff’s Office Public Information Officer Bob Kealing.
Yohiry Acosta Herrera and Justo Rodriguez Medina are accused of removing a skimmer from one pump, and installing a skimmer inside a different pump.
“It all just happened within just a few minutes,” Kealing said.
The sheriff’s office says a fraud victim reached out recently, saying the gas station near I-4 was one of the last places they used their hacked credit card.
Skimmers have become a major headache for consumers across Florida.
The Department of Agriculture says in 2019, 1,549 skimmers were found statewide. In the two months of 2020 there have been 168.
“This does happen with frequency. We are out in neighborhoods on any given day surveilling certain places,” Kealing said. “Bad guys be aware, we are on the lookout for these types of things.”
Officials say the suspects were using the skimmers on the pumps at the far end of the gas station. They say people should try and use pumps that are closer to the main building. It’s also important to check to see if the security tape has been tampered with.

There is a common sense approach to cash/debit card/credit card. First, I use my credit card everywhere possible and get the rewards. Secondly, for the few times I need cash I write a check for cash at the bank (about twice a year) and have access to my cash the few times I need it. I write a personal check maybe 5 times a year. Lastly, I don’t have a debit card/ATM card to carry around. I personally see no need for the debit/ATM card.
This “story” about Denny’s and their manager seems “strange”. Can a restaurant manager be this dumb and inept or is something missing from this “story”? I just wonder...

It is not Denny's problem. It is the card reader, provided by the merchant services Denny's chose. You need to ask Denny's who is its provider or bank and deal with the provider directly. Simple!

That is not true for some banks. BB&T doesn't offer a "bank card" that can only be used for cash at ATMs. You have to use their debit card.

My husband got cash on our Visa once by mistake. I didn't know this. Visa started charging interest on that $ from the moment he got the $. I kept seeing a .$50 interest charge on our bills every month and couldn't figure out why, because we always paid the balance. Finally I called Visa. It turns out the cash retrieved does not show up on the regular bill, and I was missing seeing it because I didn't know DH had done this.
So I had to overpay by guessing an amount on the next bill to cover the charge and interest. I would never retrieve cash from a cc. Debit card only. We probably only use $50-$100 cash a month here in the US, but overseas cash is required much more. I keep a close eye on the debit charges recorded by our bank. Been doing this for ten years with no problems. But we use cc whenever possible.

A word of advice to all of you. Go online to your bank, check the box to get a text every time you use your debit or credit card. That way you can immediately see if you have been charged the correct amount, and if someone else is using your card. NEVER ever use a debit card anywhere it will go out of your hands. That's debit card 101. I actually have a second credit card, with a low credit on it, just for restaurants and gas stations. That way, if someone gets it, I won't have to change everything online. Just use your debit card when you need cash, like at Publix when they ask if you want cash back, and at the bank. Never hand your debit card to anyone else.

Tell Dennys you are using the debit card as a form of payment and will have the credit card company reject the second fraudulent charge. I assume you have a debit and credit within the same card or if you have two cards they are with the same credit card company. Mention the word fraud.

They did not give me a receipt for the debit card charge that they said did not go through, as they said it was rejected. I have a receipt for the credit card. I ask to speak to the manager, they would not come out of the back and the woman said the manager said they will not issue credits.
Then I called Citizens Bank here in the Villages and explained what had happened and they told me Denny's has to issue a credit because of it being a debit. I told them they would not issue a credit, Citizens Bank said they would call Denny's as it is their mistake they have to issue a credit. The person at Citizens Bank said he would take care of it and I sent them a copy of the credit card receipt and they have the record on my account were they charged it the same amount. We will see if Citizens Bank gets anywhere with them.
One thing that came to my mind was the woman did this so she could pocket the money from one of the charges. Normally I would not have checked my account but I was wondering why the bank had refused the charge, then I found they had not refused it but it had gone through.

My debit and main cc are through SunTrust. When I use either card I receive a text (usually immediately) when a charge occurs. If you had this service you would’ve known immediately and you could’ve rectified it on the spot.

Your original post was not clear that the second card you used was a credit card. If it was a credit card, then you can just dispute the credit card charge with the bank, and they must immediately credit your account. That should solve your problem. There is no need to do anything about the debit card transaction.

.excellent point~some cop on the news said if we have to pay for gas with a debit, put it through as credit & it prevents the scanner from reading the numbers. idk if thats true or not, but all it will ask you for is your zip code.

We also never ever use debit cards, put mostly everything on cc with good rewards, always pay the full balance every month so no interest charges, and use a backup cc for restaurants. Sometimes tip in cash, sometimes on cc, depends on situation. I always pay my hairdresser in cash which she greatly appreciates. Haven't used an ATM in years. This system has worked for us for many years.

Probably goes without saying, but keep an eye on your accounts for while in case they try anything else. Like others have said, we only use our debit card for the ATM.

But if they used a debit card without a pin it’s the same as using a credit card and the bank will follow the rules as if it was a true credit card. At least that’s what Creditcards.com says. I know everything you read on the Internet isn’t necessarily true but I believe that is. :)

My thought is why anyone is using a debit card where the risks of losing your money making a transaction are against you. You can always dispute a credit card charge and have it removed, unlike the debit card.
If you use the right credit card, you get the extra time to actually pay for your purchase and also receive cash rebates.

We always have cash on hand just in case ,for emergencies if power goes down, etc., we have all our cc's, utilities, insurance and all other recurring payments on auto pay--no balances ever kept--another thing we do is we buy gas cards when ever we are traveling out of the area--we use a cc that gives use 5% cash back for gas + another gas card that gives us 5Cents off per gal--no chance of getting skimmed, which are very prevalent off of an interstate

Just call your creditcard company and dispute the charge as it is redundant.
I would never pay for anything with a debit card. Use cash or credit.
