It’s embarrassing however I overpaid my property taxes that were due 11-30-2020. I paid the higher amount due March 2021.

Can anyone let me know if they’ve done this? How to get the overpayment back ? Please don’t tell me to carry credit balance forward as I intend to put my home up for sale in the next 2 months or so?

I’ve contacted the tax office all I get is a recording and no return phone call. It was the phone number of Randy Mast. Thank you

You can file Form DR-462 with the county to get a refund. But, I would hand carry the form to the tax office.

Hard to believe this post. Sumter county thanks you and appreciates your generous donation. Don't call us, we'll call you.

Your over payment will be refunded in escrow when your taxes are prorated if you don't find satisfaction prior. It's not gone forever.

I can only speak as a county treasurer in PA, but our office would either return the overpayment or refund it. In your case, I would make the request to the tax office in writing or on their prescribed form. There should be no problem getting a refund; however, they will delay until sufficient time has passed for your original check to clear.

Each county has their own procedures but I worked for a tax collector in another county for a long time. We automatically refunded any overpayment in excess of $10. It may take a while as this is the busiest week of the year, processing payments, fixing issues, etc. Going down to their office won't help except that once the payment is processed (which may take a little while), they can confirm there is an overpayment and when you might expect a check in the mail. To correct some misinformation given here - all the money stays in the country, none goes to the state. Also, all ad valorem taxes and most non ad valorem taxes are paid in arrears. What we pay in November 2020 is for Jan-Dec 2020. If you sell in December, you will get a very small amount prorated at closing and all prorations are generally done at the November amount, regardless of when you pay. Each title company may handle differently but bottom line is you get no credit for overpaying the taxes. Believe it or not some people overpay their property taxes, knowing they will get a refund just so they can cheat on their income taxes - claiming the higher amount paid as their deduction. Hope that helps.

That doesn't seem to track with the refund process in Florida. The refund form is Form DR-462, which is a Florida State Department of Revenue form. You submit the form to the county, but they send it to the state for processing. So, apparently, the State of Florida processes the refund, not the county.

DR 462 is for payments made in error (like you paid the wrong account) not for an overpayment in the right account. The state has nothing to do with an over payment on the right account.

It's not true that Form DR-462 is only used for overpayment to an incorrect account. Here are the reasons listed on the Florida Department of Revenue website for filing Form DR-462:

• An approved exemption not applied to your bill
• Being billed for the wrong building or incorrect
square footage
• Being double assessed
• A miscalculated early payment discount
• A mathematical error
• Overpayment of property taxes
• Payment when no tax is due
• Payment of someone else’s taxes in error
• Payment for a tax certificate that is
subsequently corrected or amended

Maybe, but I would apply for the refund because it will go to the state office that provides oversight over the county.

He called them, but they didn't call back. He is only paid up through next March if they properly apply the discount for early payment, and apply the remainder amount to future taxes.

I'm not sure why I'm bothering ... but here goes. First, I said "like" making a payment on the wrong account. I wasn't trying to provide an exhaustive list of reasons. The point is that a general error like paying the wrong discount period will be refunded (if more than $10) automatically by the TC office without the form.
FS 197.182 (1)(a)6.(c) reads:
(c) Overpayments in the amount of $10 or less may be retained by the tax collector unless a written claim for a refund is received from the taxpayer. Overpayments of more than $10 resulting from taxpayer error, if identified within the 4-year period of limitation, shall be automatically refunded to the taxpayer (emphasis added). Such refunds do not require approval from the department.

In addition to statutes, there are rules promulgated by the Department of Revenue that provides more procedural detail that tax collectors must abide by. Before retiring, I led a statewide task force of tax collectors and the Department of Revenue and we rewrote and updated the entire 197 chapter which pertains to tax collectors. I also led the task force that then updated the rules and regulations. Although I retired 5 years ago, I still remember some of it.

If you stop payment on the check you will likely incur a charge from your bank AND a charge for a returned check by the tax collector. It is totally not necessary and will cause extra work for everyone involved. Trust me we had thousands and thousands of people who paid the wrong discount period in the county I worked in. You don't have anything to worry about.
