That's a protected Gopher tortoise, he's a land animal. I'm not trying to be a smarty pants, but sometimes people put them in ponds..... No, actually it's illegal to touch them... but okay if they are in the road.

How do I know this? I have two of them here.

My dog was on a date with him recently. He walked in one door and out the other of my lanai and the dog joined him. Very cute walking side by side. A surprise because I don't think she ever saw a tortoise before. Wish I thought to snap a picture.
