I've been reading about the US boy band "One Dimension" sueing the British band of the same name for trademark infringement. How in the world do the folks at

The Villages, FL | Terra Vista & Citrus Hills | Florida Retirement Community (http://www.thevillagesfloridalifestyle.com/index.asp)

NOT get sued for their website?? - I own a house in The (real) Villages and it took ME a couple of minutes to be 100% sure this wasn't just some strange part of The Villages I hadn't heard of yet. (I had to check the location to be absolutely sure.) I'm sure the casual retiree who had heard how great "The Villages" is would think this is a part of us.

I'm just amazed by their first sentence - "Here at The Villages, FL we believe your Florida Retirement experience is about enjoying pastimes and pleasures like never before."

WOW.

Wow, that first sentences is very confusing and clever at the same time. I guess when people get to those "villages" and ask about the town squares, polo fields, softball complexes and many other things the truth has to come out. A clever but deceptive marketing ploy I 'd say.

Good points, Wayne. It looks like their sprinkling in of the word "The" here and there is what creates the confusion.......perhaps intentionally!?

Why sue? In all likelihood of the suit being won is slim to none and our TV would be stuck paying legal and court fees. All that would be accomplished in the end is that the other TV will gain some valuable publicity while we get negative publicity, and I don't that that's what we want! Anyway, it wouldn't surprise me if the powers to be here in TV haven't already considered it.

I went to their website and had an online chat with them. They were very honest to say that they are NOT "THE Villages" that is advertised on television. They said they are 50 miles north of The Villages. I don't think they are trying to pull the wool over anyone's eyes.

Husband & I had a look round here about 5 years ago. We were just being nosey! The homes were lovely, really lovely, fabulous designes etc.

The sales person told us that the homes we had just veiwed would be demolished within the next month or so!! Could not believe it, what a waste.

The facilities were not nearly as good as the villages.. In fact not a lot to do at all!

Ok, they are quite close to the ocean, but the view looking north, not good, the nuclear power plant. Looks better at night.

To sue would be silly. The REAL Villages is building as fast as they can. They don't need to advertise anymore on Television or give away a lot on LSV. They have tons of people waiting to move here and even some annoying younger people now want to live here too. (Those who run shirtless, as if aging doesn't already give you blood pressure issues...) ;)

Back to the subject..No need to sue. That site may catch some dumb folks we don't need here.

To refer to the place as "The Villages, FL", with the "The" capitalized as if it were part of the name, seems deceptive to me. I think Wayne is correct that The Villages, FL might need to consider some legal action. If you don't protect a trademark, you can lose it. At the very least, TV's legal department might think it prudent to send a cease and desist letter, if it hasn't done so. Or it could be that TV doesn't have a trademark for The Villages and The Villages, FL, which would be a shame. I did write Janet Tutt to ask if TV is aware of this. I'll let you know what she says.

No trade mark, therefore no grounds on that count.

THE VILLAGES GUIDE.COM is trademarked by

there were several other communities using the term already
